Surfschool and sport courses:

Rental company terms for kite-, windsurf and stand up paddle equipments:

The DE SILVA Windresort Kalpitiya is a VDWS licensed kite- and windsurf school and offers the latest equipment for rental and instructions.

Precondition to borrow surf equipment at DE SILVA Windresort Kalpitiya, is the presentation of an approved basic license or the receipt of a successfully stored basic course.

All students of DE SILVA Windresort Kalpitiya explain that they are physically healthy and have no sufferings which do not allow a secure and careful use of the sport devices. Furthermore, they assure that they are able to swim at least 30 minutes.

Everybody who has completed the 18th year, is entitled at the participation of the sports courses and at the rental company. All minors or infants have to bring a permission of a parent or guardian. With it the parent/legal guardian declares his child for selfresponsibly enough to take part in the sports lessons/to rent material. The participation in the sports courses, as well as the claim of all offered achievements, furthermore the journey and the stay occurs on own risks. All responsibilities and costs have to be taken by the permission of a parent or guardian.

The DE SILVA Windresort Kalpitiya, kite school – windsurf school – SUP, assumes no liability for accidents of the participant. The disclaimer of liability is also valid for damages which thirds suffer on account of a fault of the participant. The participant has to provide himself for a sufficient accident assurance and health insurance. The student/ tenant/renter sticks for all resulted damages which originate in or by the rent material. Damages must be announced immediately to the station. The student or tenant/renter has to sustain the costs of the repair himself and to pay cash.

Should the rent material not be brought back on time, every next started half an hour will be charged. A valid identity card must be deposited.

General terms and conditions for windsurf- and kitesurf course

I am aware that the participation at the windsurfing course / kitesurfing course makes special demands for the physical constitution and I assume the full risk for my participation in this education. I explain that I am physically healthy and have no sufferings which implicate to exclude a participation of the course or advise against it. I assure furthermore that I can swim at least 30 minutes.

Safety and duty of care

The assignments of the windsurfing- / kitesurfing-instructor have to be obeyed without limitation. By not obeying the instructions, or by lasting disturbances of the instruction, the teacher is entitled to suspend the participant immediately. There is no reimbursement in case of an exemption.

If the security is not guaranteed by observances of the instructions or by careless or even deliberate behavior, the teacher can exclude the course participant from the course. There is no reimbursement in case of an exemption.

Liability

The participant declares to know that all forms of the wind- and kitesurfing (on the water, as well as on the beach) are connected with special risks. We assume no liability for accidents of the participant. The disclaimer of liability is also valid for damages which thirds suffer on account of a fault of the participant. The participant has to provide himself for a sufficient accident insurance and health insurance. We provide a conscientious course preparation, the careful choice and supervision of the teaching team and the proper performance of the by contract agreed achievements. We cannot guarantee for wind and weather. As a result of that, a short-term temporal and local transfer can become necessary.

Resort and accommodation:

De Silva Windresort

DE SILVA Windresort Kalpitiya currently offers 5 Cabana houses and 4 standard rooms which are equipped in each case with an own bathroom inlcuding shower and toilet. Furthermore every lodging disposes of an own terrace/balcony which is available to the tenant of the object for the respective period. In addition, the Resort has 4 rooms in the guest house including a common sanitary arrangement (with showers and toilets) built nearby.

The rooms are non-smoker’s areas and a careful use is expected in the whole Resort. For selfcaused damages to the rent object or within the Resort, or damages caused by third in/of the rent object, the tenant is liable therefore and has to announce it to the Resort management immediately.

Electricity supply is given 24 hours a day. To the present state air conditions are not provided, but we offer fans for cooling the rooms.

The water from the taps and showers are only heated from solar energy and suites for showering, washing and dental cleaning. Not for drinking. Drinking water is offered to purchase but also included during mealtimes.

It is asked and expected, that a careful and ecologically use of water is kept in the whole Resort (eg: shower, surfstation).

Full board in the form of breakfast, snack for lunch and dinner is offered in the room price as included. Drinks and dishes can be ordered during the cooking-/restaurant hours.

The observance of night’s rest after 22:30 o’clock at local time is requested. An employee of DE SILVA Windresort guards the Resort 24 hours and is responsible for night’s rest and security.

De Silva Palmresort

DE SILVA Palmresort Kalpitiya currently offers 19 rooms rooms for singles, couples and families. Those are equipped in each case with an own bathroom inlcuding shower and toilet. Furthermore every lodging disposes of an own terrace/balcony which is available to the tenant of the object for the respective period. In addition, the Resort common sanitary arrangement (with showers and toilets) built nearby at the swimmingpool and also toilets at the reception.

Electricity supply is given 24 hours a day. To the present state air conditions are provided in most of the rooms which must be payed extra, but we offer fans for cooling the rooms also.

For both resorts:

Every now and then or to given occasions DE SILVA Windresort organises parties with music. To these occasions the night’s rest is valid from 2 o’clock or after the party is official finished. In the spite of playful mood, we ask to keep these times and to show consideration on each other. With non-observance and disturbances of the given expiry the disturbing person is her-/himself liable.

Bringing of domestic animals is not permitted.

Booking process, cancellation policy and terms of payment:

Booking process and reservations: The registration can occur in writing, by e-mail, by telephone or personally. A reservation of the lodging is activated by 50% of deposit, confirmed by DE SILVA Windresort Kalpitiya /DE SILVA Palmresort and is obliging therefore. Reservations of equipment or courses can done in advance or directly on the spot (according to availability). The duration of the course is to be taken from the course regulations. A course is completed after consultation with the instructor team. The everyday course times begin with the meeting in the station and also end again there. The course participant has the responsibility together with the instructor team to take down the daily course times truthfully.

Cancellation Policy:

1. Cancellations made thirty (30) or more days prior to the date of arrival will be issued as a voucher for your next stay at one of our resorts.
2. Cancellations made less than thirty (30) days before arrival will incur a 50% charge as cancellation fee.
3. No show or cancellations after arrival on site will incur a 100% charge as cancellation fee.
(Exceptions for no show up: serious illnesses, accidents, natural disasters).

With regard to the Corona crisis, advance payments already made until before 31.12.2020 can only be issued as vouchers. All new bookings do not require a mandatory down payment until 31.12.2021.

In dependence of the weather conditions the course times possibly vary. In case of nonappearance of the course-participant at the agreed appointment, the participant himself takes over the responsibility and there is no refund. DE SILVA Windresort Kalpitiya cannot overtake any liability for wind or weather.

Terms of payment: 50% of deposit of the whole invoice amount occurs with reservation on the stated bank account. The balance is to be paid on arrival in cash (€/USD/Rs) or with credit card (3% fee) immediately.

In case of suggestions, wishes or complaints we ask the participant / tenant to approach the Resort management immediately. Hereby we would like to refer to the fact that DE SILVA Windresort Kalpitiya has no European standard and is no package-holiday provider. But DE SILVA Windresort Kalpitiya will ensure best possibly standards and tries to make the vacation as nicely as possible.

With deposit you accept all company terms.

Hotel policies check in/check out

STANDARD Check in = 01:00 pm,

STANDARD Check out = 11:30 am,

Early or late check in/outs can only be given in case of availability.

EARLY CHECK-IN POLICY The hotel will charge half night (50% of the room rate) for an early check-in between 06:00 am to 01:00 pm, or full night (100% of the room rate) for an early check-in before 06:00 am Sri Lanka time.

LATE CHECK-OUT POLICY Late check-outs until 07:00 pm will be charged for a half night (one-half of a full night’s room charge), while late check-outs after 07:00 pm will carry a full night room charge.
